The real risks of buying off plan, and what actually protects you

Escrow accounts and RERA registration remove one category of risk entirely. Delay and market timing they do not. Here is the honest split.

Off plan carries risks worth naming plainly. Some are structurally managed by Dubai's regulatory framework. Others sit with you, and no amount of paperwork moves them.

What the regulation genuinely handles

Your money disappearing

Buyer payments on a registered off plan project go into a project-specific escrow account, not the developer's operating account, and are released against certified construction progress. This is the single most important protection in the Dubai market, and it is why project registration is the first thing to verify.

A project vanishing without recourse

Where a project is cancelled, the DLD and RERA operate a defined process for liquidating the escrow account and returning funds to buyers. It is not instant and it is not painless, but it is a process, not a void.

What remains yours to manage

Delay

The most common off plan disappointment is not fraud, it is time. Construction slips. Your protection is the SPA's delay provisions and, more practically, the developer's own delivery record: how close recent completions ran to their announced dates. That record is knowable before you buy, and it is the question we answer first on any project we list.

Market movement between purchase and handover

You are buying at today's price for a building that completes in two to four years. That gap is where off plan capital growth comes from, and it is also the risk. If your plan depends on selling before handover, understand the assignment terms and the fact that resale liquidity varies sharply between projects.

The gap between the render and the room

Specification is contractual: what is in the SPA is what you are owed. Marketing imagery is not. Compare the finishes schedule, not the brochure, and where a developer has completed nearby, walk a finished building.

Service charges you have not seen yet

A building's running cost is set after completion and can materially change an investment case, particularly in towers with extensive amenities. Ask for the developer's estimate and compare it against actual charges in comparable completed buildings.

The five questions to ask on every project

  1. Is the project registered with the DLD, and what is the escrow account?
  2. What has this developer delivered before, and how late was it?
  3. What does the SPA say about delay, area variance and assignment?
  4. What is the estimated service charge per square foot at handover?
  5. What is the payment schedule against my actual cash flow?

An Investment Advisor who cannot answer the first two from memory is not close enough to the project to advise you on it.
